Do Iowa home sellers have to disclose property defects?
For covered residential transfers, Iowa requires a written disclosure statement before the seller makes or accepts a written offer. The law has exemptions. A disclosure describes relevant property conditions; it does not replace an independent inspection.
Iowa Code chapter 558ADoes a seller’s disclosure guarantee the condition of a home?
No. Iowa’s disclosure law addresses the seller’s knowledge and good-faith disclosure. Liability and exceptions depend on the circumstances. Buyers can still have inspection and contract questions that deserve separate review.
Iowa Code §§ 558A.3–.6Does an Iowa real estate agreement need to be in writing?
Iowa’s statute of frauds generally requires signed written evidence for agreements creating or transferring interests in land, with exceptions. A handshake or informal exchange can raise difficult enforceability questions.
Iowa Code §§ 622.32–.34What should I bring to a property-law appointment?
Bring the complete purchase agreement, amendments, deed, lease, available title documents, survey and relevant notices. A short timeline and any closing or response dates help the office understand the conversation.

What makes a will valid in Iowa?
Iowa generally requires a written will, the required signature and declaration, and two competent witnesses signing with the required presence formalities. Special rules apply in some situations. Notarization alone does not replace the witness requirements.
Iowa Code § 633.279What happens if someone dies without a will in Iowa?
Iowa’s intestacy rules determine who inherits property subject to those rules. The result depends on the family relationships, including a surviving spouse and children. It may differ from what the person would have chosen.
Iowa Code §§ 633.210–.226Is a financial power of attorney the same as a health care power of attorney?
No. A financial power of attorney authorizes an agent to handle specified financial matters. Health care decision-making is governed separately. The document’s wording and applicable law determine the scope of each authority.
Iowa Code chapter 633B; health care: chapter 144B Iowa Code chapter 144B ↗Can a power of attorney be used after someone dies?
An Iowa financial power of attorney terminates when the principal dies. Authority to administer an estate is a separate matter; being named an agent does not by itself make that person the estate’s executor.

Probate
A little clarity after a loss.

What is probate in Iowa?
Probate is the court process for administering an estate: addressing the will, appointing a personal representative, handling estate assets and claims, and distributing what remains. The process depends on the estate.
Iowa Code chapter 633Who can act as the executor of an Iowa estate?
The will may nominate an executor, but court appointment supplies authority to act in probate. Iowa law sets appointment preferences and qualifications. A nominee should not assume that nomination alone permits estate transactions.
Iowa Code § 633.294How long does probate take?
There is no single completion date for every estate. Required notices, claims, property sales, taxes and disputes can affect timing. Ask about the process for the particular estate before promising distributions to beneficiaries.
Iowa Code chapter 633What documents help start a probate conversation?
Locate the original will if available, death certificate, existing court papers and a general list of assets, debts and family contacts. Ask the office how to provide sensitive records securely.

Contracts & business
Understand the commitment before signing.

Does every contract in Iowa have to be written?
Not every agreement requires a writing. Iowa’s statute of frauds covers specified categories, including certain land agreements and agreements not to be performed within one year. Exceptions and other laws can change the analysis.
Iowa Code §§ 622.32–.34How long do I have to sue over a written contract?
Iowa generally provides ten years for actions founded on written contracts, but the claim type, accrual date and special rules matter. Do not treat that general period as a deadline calculation for your dispute.
Iowa Code § 614.1(5)What should be reviewed before I sign a business agreement?
Useful discussion points include the parties, scope of work, payment, deadlines, termination, warranties, liability, dispute procedures and personal guarantees. Provide the entire agreement and attachments so the review has context.
What should I bring if a contract has been breached?
Gather the signed agreement, amendments, invoices, payment records and messages about performance. Note what each side promised, what happened and any notices or deadlines. Preserve original records.

Litigation & personal injury
Questions when a dispute changes daily life.

How long do I have to file a personal injury lawsuit in Iowa?
Many Iowa personal injury actions have a two-year limitation period. Different claims and defendants can involve different rules, earlier notice requirements or exceptions. An attorney must assess the actual deadline; insurance discussions do not safely substitute for that review.
Iowa Code § 614.1(2)Can I recover damages if I was partly at fault?
In cases governed by Iowa’s comparative-fault law, allocated fault can reduce recovery and, if the claimant’s fault exceeds the combined fault of the specified other parties, bar it. How that rule applies depends on the case.
Iowa Code § 668.3What types of disputes can go to Iowa small claims court?
Iowa small claims generally covers civil money claims of $6,500 or less, and certain landlord-tenant possession cases. It uses specific filing and response procedures and is heard by a judge. The right court depends on the requested relief.
Iowa Judicial Branch: Small claimsWhat happens if I ignore small claims papers?
Failing to respond as required can lead to a default judgment. Read the served papers and their deadlines promptly. Court staff can explain procedures, but legal strategy requires advice about your circumstances.

Family law
Clear information through personal change.

Is Iowa a no-fault divorce state?
Yes. Iowa allows divorce when the marriage has broken down with no reasonable likelihood it can be preserved. A spouse need not prove a particular misdeed. Property, support and parenting issues still require resolution.
Iowa Judicial Branch: DivorceHow long does a divorce take in Iowa?
Iowa generally has a 90-day waiting period beginning when the respondent is served. A court can waive it in certain circumstances. That is a minimum waiting rule, not a guarantee that a divorce will finish in 90 days.
Iowa Code § 598.19; Judicial Branch overviewHow is child support calculated in Iowa?
Iowa courts apply the Iowa Child Support Guidelines. Income and case-specific circumstances affect the calculation, and departures require the necessary findings. A generic online estimate does not determine the amount owed under a court order.
Iowa Judicial Branch: Family law FAQsDoes joint legal custody mean equal parenting time?
Not necessarily. Iowa distinguishes legal custody, which concerns important decisions for a child, from physical care, which concerns the child’s home and routine care. Joint legal custody does not itself require joint physical care. The child’s best interests guide the court.
Iowa Code §§ 598.1 and 598.41Can I stop paying child support if I am denied visitation?
An existing support order continues to apply even when visitation is disputed. The issues are separate. Follow the order and discuss the appropriate legal process for the parenting dispute rather than withholding court-ordered support.

How can I find out what charges I face in Iowa?
Start with the complaint, citation or charging papers. Public case information may also appear on Iowa Courts Online. The exact charge and procedural stage matter, so bring the documents when discussing representation.
Iowa Judicial Branch: Criminal casesCan I get a court-appointed attorney?
A person unable to afford counsel in a criminal case may apply. A judge determines eligibility under Iowa law; appointment is not automatic. Depending on the circumstances, repayment of attorney fees may be ordered.
Iowa Judicial Branch: Court-appointed counselDoes paying bail mean the criminal case is over?
No. Bail concerns release while a case proceeds. The judge’s bond conditions control what may be posted, and cash bond is released only under the applicable court order or dismissal process.
Iowa Judicial Branch: Bond FAQsWhat if I miss a scheduled criminal court appearance?
Missing an appearance can have serious consequences, including additional penalties. Check the court notice carefully and contact your attorney promptly about an issue attending. Do not assume an online message changes a court date.

Taxation & income tax
Make tax season a little more manageable.

When is an Iowa individual income tax return due?
The usual Iowa individual income tax deadline is April 30 following the tax year. Weekend and holiday rules, special relief and individual circumstances can affect dates. Check the current tax-year instructions; federal deadlines are separate.
Iowa Department of Revenue: Individual incomeHow do I get an extension to file my Iowa tax return?
Iowa generally allows an automatic filing extension to October 31 if at least 90% of the correct tax is paid by the original due date. No Iowa extension form is required. Interest can still accrue on unpaid tax; federal extensions do not apply for Iowa purposes.
Iowa Department of Revenue: Filing extensionsDo self-employed people need Iowa estimated tax payments?
Income without sufficient withholding can require estimated payments. Iowa has payment schedules, underpayment rules and exceptions, including special rules for farmers and fishers. Review the current-year instructions before relying on a prior year’s payment amount.
Iowa Department of Revenue: Estimated paymentsWhat should I bring for income tax preparation?
Ask the office for its current checklist. Common starting records include prior returns, wage and income statements, business income and expenses, and estimated payment records. Provide tax documents securely, rather than through a general website inquiry.
